My Terms Of Use are the same as most other original artists, so most of you are already familiar with these terms. Graphic artists put a lot of time into creating graphics for your use, so please, read them carefully. By downloading or purchasing my graphics, you are agreeing to my TOU (even if you have not read them).

Obligation

You MUST have a working website. No Under Construction generic pages. I need to be able to see that you will follow my terms. If you do not have a website and would like to purchase a sig tag from me please let me know where and how you will be using it and supply me with a valid email address.This also means you must give credit for each graphic used with a link back on each page that you use my graphics, (Not a Graphic's Credit Page) and must be linked to the main site and not to any of the other pages on my site.
My graphics are for use on family friendly pages only. The content (be it text or images) should be appropriate for viewers of ALL ages. This includes any pop up ads. Meaning, your pages must be able to be viewed without a parent being worried about policing the content and say what is or is not appropriate for their children to click on! You may NOT use any of these graphics on a site containing pornographic, violent, racist or vulgar material. Your site should not support or encourage abuse to humans or animals, hatred, illegal activities, discrimination or anything that degrades any race or group of people.
Your site MUST be in French, in English or in Spanish or have a French, English or Spanish translation, so I can read and understand it.
When you purchase a graphic, you are purchasing the rights to use that graphic, on your web site only, either as an adoption or for your private collection, and for that purpose only. I will not sell an identical adoption to anyone else. (However I reserve the right to offer that graphic for other purposes and uses either now or in the future.) I still hold the copyright to that graphic. I retain copyright and ownership on all the graphics that I made (Purchaseware and linkware).
I must have access to my graphics at all time even if your site is passwords protected. I'll require access to this at all times to be able to view the graphics are made.
You MUST load the images to your OWN server or website directory.

Purchaseware and linkware

Graphics may be used as is to decorate your non-commercial and commercial websites.
You may use the graphics for your personal craft projects only, like cards, gifts, scrapbook and print them for that purpose but you must to add: graphics copyright © Blueberry Pixels. It is not allowed to use any of my graphics (linkware or purchaseware) for printing purpose in any commercial way without contacting me and without my prior written consent. You may NOT use any of these graphics in emails, tubes, collections, CD, banners, stationery, cards, quilts, stamps, etc. or create any other graphics with them. They are NOT to be redistributed or claimed as being drawn by you! NO exceptions.
It is ok if you mix and match between the sets.
Do NOT share my graphics with others through the internet, email or otherwise in any way, free or for commercial purposes.
Do NOT alter the gaphics in ANY way (change, colorize, resize, text, or modify, etc.) without specifically indicated approval (exception of adding text to any supplied blank button or image designed for this purpose).
You must have ALL of the following scripts installed in on your pages: No Right Click, No Toolbar Image and No Drag & Drop. If you need some help about that, please refer on the Required Codes section (on the main page), you'll have all of them there.

Tubes packages

You may make siggies, premades and websets for personal use or for sale.
You must give the proper credit on the page you displaying the tubes and link back to Blueberry Pixels with the matching certificate or, at least, a written link.
I retain the copyright of all my tubes, you may NOT claim them as your own.
All sales are final. NO REFUNDS will be given once the tubes package has been sent.
You may NOT alter, recolor or resize my tubes in any manner, make lineart with them or offer them on a cd, in a member area or in any group. You may NOT sell my tubes as is, you must add something to them and make your own graphics.

General

Always place a link to Blueberry Pixels on the same page (every page) where the graphics are used. Premades and blog bits must be linked back to Blueberry Pixels with the provided link back certificate. No text links please. You MAY use text links ONLY for sigtags.
If for any reason I ask you that the graphics that I did be removed from your site, you will be given 48 hours to comply. Violations of the TOU could subject you to this request.

Purchases

All payments are to be made in US Funds. I accept PayPal only.
If you haven't sent payment within 48 hours of my billing you (according to the time on my PayPal receipt), I'll cancel the billing and put the graphic back up for sale.
All sales are final. NO REFUNDS will be given once the graphic(s) has been sent.
Purchased graphics will be sent to you only when payment have been received.
The secret words are: I respect your TOU.

If at any time you have questions please email me. I reserve the right to refuse sale to anyone and to change my terms at any time and without prior notice. Any changes in terms will apply to all purchases, past and present.
